TERMS AND CONDITIONS
These terms and conditions (the "Terms and Conditions") govern the use of www.canadianbeerleague.com (the "Site"). This Site is owned and operated by Beer League Hockey Inc. This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Beer League Hockey Inc. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Accounts
When you create an account on our Site, you agree to the following:
You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

These Terms and Conditions govern the sale of goods and services available on our Site.

The services will be paid for in full when the services are ordered unless a payment plan option is selected at checkout.
These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.
Payments
We accept the following payment methods on our Site:

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:
Standard delivery by Post.
Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and statutory holidays.
You will be required to pay delivery charges in addition to the price for the goods you purchase.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Refunds
Refunds for Goods:
All goods sold on our Site are non-refundable unless there’s an issue with the product itself.
Refunds for Services:
We provide refunds for services sold on our Site as follows:
If greater than one week from the beginning of a season a registrant wants a refund for any reason, they will receive a full refund minus a transaction fee. (The transaction fee will be approximately 3% of the total initial payment).
If a registrant wants a refund within one week of the first skate in a season, that person can be provided with a refund minus the transaction fee, and minus an additional $25 fee for jersey and shipment fees, or a credit valued at the total initial payment amount for a future season without the deduction of the transaction fee or jersey fee.
If someone wants to withdraw from a season in progress before the halfway mark, that person can be provided with a partial refund that accounts for the transaction fee, jersey fee, sessions/games already played as well as the next session on the calendar, or credit for future registrations at the discretion of Beer League Hockey Inc.
If a request is made for a refund after the first half of a season is completed, and the reason for the request is not related to injury incurred during a CBL program, or a reason within the reasonable control of Beer League Hockey Inc. then a refund is no longer available.
Program Dismissals
Beer League Hockey Inc. is committed to providing a safe, fun, and friendly environment for all participants. All members are required to adhere to the Canadian Beer League Code of Conduct, which outlines the expected behaviour of all players, both on and off the ice.
Canadian Beer League reserves the right, at its sole discretion, to suspend or dismiss any participant from its programs for any conduct that is deemed to be in violation of the Code of Conduct, or which is otherwise detrimental to the league, its members, or its values. This includes, but is not limited to, actions, language, or behaviour that is abusive, discriminatory, unsportsmanlike, or dangerous. Canadian Beer League also reserves the right to remove players whose skill level is egregiously superior to that of the target participants’. Skill level is subjective and whether or not someone is too skilled for the league is at the discretion of Canadian Beer League and is based on factors including observing the players directly, feedback from participants, and feedback from officials.
Disciplinary Process:
In the event of a reported or observed violation of the Code of Conduct, Canadian Beer League will conduct a review of the incident. This review may include discussions with the individuals involved, officials, available footage, and any witnesses. Based on the findings of the review, Canadian Beer League may impose disciplinary action, up to and including immediate and indefinite dismissal from the season or event.
Refunds for Dismissed Participants:
Individuals who are dismissed from a program will be eligible for a pro-rated refund for any future programming they have already paid for. This refund will be subject to deductions for any transaction fees, jersey costs, and programming fees already incurred up to the date of dismissal.
Text Messaging (SMS) Terms & Conditions
By opting into or participating in any of our text messaging programs, you accept and agree to these terms and conditions.
Program Description:
We offer various SMS programs to keep you informed about our company. These programs may include marketing and promotional messages, account-related updates, and other alerts. The specific type of messages you receive will depend on the program you've opted into.
Consent
When you subscribe to an SMS program, you give us your express written consent to receive recurring automated and/or pre-recorded text messages from us. This consent is not a condition of purchasing any goods or services from us.
Opting Out
You can cancel the SMS service at any time. To stop receiving messages from a specific program, simply reply STOP to any message you receive. Message and data rates may apply for any messages sent to or from you. Please check with your mobile carrier for details about your specific plan. You are solely responsible for any charges associated with receiving our text messages.
Disclaimer
We are not liable for any delays, delivery failures, or damages arising from the use of our SMS services. We are also not responsible for undelivered messages.

Eligibility

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Beer League Hockey Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the Province of Ontario.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
